California State Rules prevent a Notary Public from telling clients which “act” need, Acknowledgment or Jurat.
NP Tip: Jurats are for Oaths and contain, “swear or affirm”.
NP Tip: Acknowledgments verify the identity of a signer.
JURAT – A Jurat is an Oath and the wording in the section of the form that the Notary completes asks the signer to “Swear or Affirm”. These are common for employment contracts, public officials assuming office, etc.
ACKNOWLEDGMENT – An Acknowledgment is the verification of the identity of the document signer. The Notary is not stating that the document is accurate or even that the signer understands what they are signing. The Notary is there to observe the signer signing the document and verifies their identity through Driver License or other acceptable photo ID.
